House bill proposes repeal of DRA imaging cuts

Opposition continues to build against the budget cuts contained in the Deficit Reduction Act of 2005. A member of the U.S. House of Representatives introduced a bill on April 27 that would repeal the DRA's cuts to Medicare reimbursement for imaging services.

H.R. 5238 was introduced by Rep. Carolyn McCarthy (D-NY) and would repeal the sections of the DRA that applied to imaging payments. The bill was introduced into the House Committee on Energy and Commerce and the House Committee on Ways and Means.

The bill is the first legislative attempt to stave off some $2.8 billion in Medicare cuts in reimbursement for imaging studies conducted outside hospitals due to take effect in January 2007. Several lawsuits have been filed attempting to have the DRA declared unconstitutional due to a clerical error that prompted the House and Senate to pass different versions of the legislation.
