U.S. court confirms Verasonics arbitration award

Research ultrasound technology developer Verasonics said the U.S. District Court for the Western District of Washington has confirmed the company's final award of more than $5.6 million in a binding arbitration ruling against Korean ultrasound firm Alpinion Medical Systems.

In June, an arbitrator found that Alpinion had breached both nondisclosure and lease agreements with Verasonics and had misappropriated the company's trade secrets, Verasonics said. The arbitrator's final award for Verasonics included $2.9 million in compensatory damages and more than $2.7 million in attorney's fees, arbitration fees, and other expenses.

Furthermore, the arbitrator entered a worldwide injunction prohibiting Alpinion from marketing or selling its E-Cube 12R research ultrasound system, or any research ultrasound system derived from or based upon Verasonics' trade secret information, and/or confidential information supplied under the nondisclosure agreement and/or lease agreement. In addition, Alpinion is enjoined from using Verasonics' trade secret information and/or confidential information supplied under the nondisclosure agreement and/or lease agreement, Verasonics said. Both injunctions are effective for five years.
