Maui radiology group loses contract battle
 July 13, 2012 -- A Hawaii district judge ruled July 11 that the court does not have jurisdiction over a Maui-based radiology group's suit against its former employer, and dissolved a temporary restraining order that prevented the new radiology provider that the hospital has chosen from working, according to a report published in Maui News.

Maui Radiology Associates (MRA) brought suit against Maui Memorial Medical Center last year when the hospital issued a request for proposal (RFP) for a new radiology services provider, claiming that the three other providers who bid for the contract should be disqualified because they did not have physicians ready to work at the time their proposals were submitted, Maui News reported. But Judge Kelsey Kawano of Maui's 2nd District Court stated that the hospital procurement process is not regulated by the court and that there was no basis to allow judicial review of the case, according to Maui News.
MRA has been providing radiology services to Maui Memorial Medical Center since 2004. On May 29, the Maui Regional Board of Hawaii Health Systems voted to overrule the hospital's executive committee recommendation in favor of MRA and give the two-year contract to RadCare, a national healthcare company in Dallas, Maui News reported.
RadCare had been poised to begin providing radiology services July 5, but was stayed with a temporary restraining order brought by MRA on July 2. With Kawano's ruling, RadCare began providing service on July 11, Maui News said. | |
