The U.S. District Court for the Eastern District of Wisconsin has dismissed an amended complaint filed against Orbotech by GE Healthcare of Chalfont St. Giles, U.K.
In granting the motion, the court ruled that the weight of both public and private factors support resolution of the action in the Israeli courts, according to Orbotech of Yavne, Israel.
Last month, GE amended its complaint against the Israeli electronics technology firm over the supply of cadmium zinc telluride (CZT) modules, expanding its litigation to include some of the breach of contract claims that were previously requested for arbitration in Israel. GE is requesting compensatory, consequential, exemplary, and punitive damages in an unspecified amount, according to Orbotech.
In its original complaint, filed November 4, 2008, in the U.S. District Court for the Eastern District of Wisconsin, GE alleged that Orbotech was obligated to supply GE Medical Systems Israel with CZT modules at a specific price per module.
Dismissal of the amended complaint is subject to Orbotech's acceptance of certain conditions set by the court designed to ensure the adequacy of the Israeli forum, according to the company. Orbotech said it intends to accept the conditions imposed by the court and has until July 16 to do so.
